By accessing or using Devertise (https://devertise.com), including our web application, APIs, and associated services, you agree to be bound by these Terms of Service.

If you are registering on behalf of an entity, organization, or business, you represent and warrant that you have full legal authority to bind that entity to these Terms.

If you do not agree to any part of these Terms, you must discontinue your use of our platform immediately.

Users must be at least 18 years old or possess legal parental or guardian consent to establish an account.

Authentication is secured via Clerk. You are responsible for safeguarding your credentials, session integrity, and any activities conducted through your account.

Accounts are categorized into distinct roles: Developers, Sponsors, and Platform Administrators. You agree to provide accurate, truthful, and updated identity and business details during onboarding.

Developers may list verified software repositories, open-source projects, and digital platforms to solicit promotional sponsorships.

All listings undergo administrative verification to validate audience authenticity, repository health, and metrics veracity before appearing in public discovery.

Developers represent that they own or hold requisite open-source licenses to showcase their software and agree to deliver sponsored ad placements exactly as contracted in agreed proposals.

Sponsors may discover verified software creators, submit targeted inquiries, initiate proposals, and fund sponsorship campaigns.

Sponsor ad creatives, marketing collateral, and external links must adhere to platform standards. Content that is defamatory, malicious, deceptive, or infringing intellectual property is strictly prohibited.

Sponsors agree to verify deliverable milestones and release payments promptly in good faith upon satisfaction of mutually established campaign milestones.

Payment processing and subscription billing are powered through our authorized merchant partner, Paddle.

Devertise charges an agreed platform commission on completed campaign transactions to support infrastructure, dispute mediation, and milestone payment coordination.

Premium developer tier subscriptions grant enhanced discovery features and reduced milestone commission fees. Subscription terms and cancellation policies are detailed transparently within account settings.

In the event of non-delivery, creative discrepancies, or milestone contention, either party may escalate an active campaign to platform dispute mediation.

Devertise platform administrators review submitted evidence, chat records, and verification logs to issue binding milestone adjustments or refunds.

Accounts found violating platform trust, submitting fraudulent metrics, or exhibiting abusive conduct are subject to standing enforcement, temporary suspension, or permanent termination.

Devertise provides the marketplace platform on an 'as-is' and 'as-available' basis without warranties of any kind, whether express or implied.

We do not guarantee specific sponsorship conversion rates, developer revenue, or continuous error-free availability.

To the maximum extent permitted by applicable law, Devertise shall not be liable for indirect, incidental, special, or consequential damages resulting from platform interactions.
